Most PEOs require five employees. Foothold America designed PEO+ for international companies that often begin their journey slowly, so we welcome clients with just one employee. PEO+ is ideally suited for five to 50 employees.
To manage the compex ever-changing landscape of employment law, Foothold America relys on in-house and third-party experts.
The PEO and client have a co-employer relationship with employees. From the IRS perspective, the client company is the legal or Common Law Employer (CLE) and because the PEO processes payroll and end-of-year tax documents, they are considered by the IRS to be the employer of record. Please note, this is different than an Employer of Record service, which does not require a US entity.
Absolutely. Everyday management, performance, pay, and benefits decisions all remain with the client. The PEO has a legal obligation to deny hiring and demand firing of those without a legal right-to-work in the US. Please see the Client Service Agreement for details.
With PEO+, there are two interdependent contracts; one with Foothold America, and one with the PEO processor, Vensure Employer Solutions. PEO+ service is provided via a 12-month renewal contract that can be terminated with 60-days notice following the first year’s term.
Yes! While standard PEO services don’t include the development of policies and procedures, Foothold America created PEO+ to help international companies fully develop their people infrastructure.
As the employer, you have control over performance and disciplinary actions. However, your dedicated HR & Client Service manager is by your side to ensure you are aware of US best practices and regulations.
Yes. When possible, we manage audits and investigations. When your company must respond directly, we back you up.
PEO+ Cross-Border Support™ is a comprehensive PEO solution that has all the turnkey benefits of a PEO (payroll, benefits, compliance, and withholding tax administration, etc.), plus the additional advice and admin support required by international companies doing business in the US. We lead the setup of your US HR program and develop bespoke onboarding processes that align with the way you do business in your home country.
